Consumer alleges Wesbanco failed to honor money market certificate

MORGANTOWN – A Monongalia County woman alleges a bank has failed to honor the terms of a money market certificate.

Crystal Gayle Ellifritz filed a complaint in Monongalia Circuit Court against Wesbanco Bank Inc. alleging breach of contract, conversion of property and constructive fraud.

The suit states that the plaintiff's father purchased a money market certificate for her benefit in December 1980 from a bank that merged into Wesbanco Bank Fairmont.

The plaintiff alleges she presented the original certificate to the defendant in 2018 and was told that the defendant had no information relating to the certificate. She alleges she has made demands for payment consistent with the certificate and the defendant has "stonewalled" all attempts for payment and information.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs, and a trial by jury. The plaintiff is represented by Frank E. Simmerman Jr. of the Simmerman Law Office PLLC in Clarksburg.
