Parent files suit against Elk Run Coal, driver over collision

FAYETTEVILLE – A Dixie mother is seeking damages from a company and its driver over a collision.

Jessica Lanham, individually and on behalf of her minor daughter, Khole Lanham, filed a complaint in Fayette Circuit Court against Elk Run Coal Co. LLC; Elk Run Coal Co. LLC, doing business as Republic Energy; and Richie W. Neal alleging negligence. 

The suit states that on Oct. 28, 2017, the plaintiff and her minor child were traveling north on county Route 2 and were about to turn off onto Smith Creek Road when their vehicle was rear-ended by an Elk Run vehicle operated by Neal. The plaintiff alleges she and her child were caused to suffer injury and other damages due to the collision.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Henry E. Wood III of Wood Law Office LC in Charleston.
