CHARLESTON – A Kanawha County woman alleges she sustained an injury to her left hand because of the actions of a Charleston Area Medical Center phlebotomist.

Reba J. Tolbert filed a complaint in Kanawha Circuit Court against Charleston Area Medical Center Inc. alleging negligence.

The suit states that the plaintiff was an inpatient at the defendant's facility on March 9, 2017. The plaintiff alleges she sustained an injury to her left hand while a phlebotomist was performing a venipuncture procedure. The plaintiff alleges the phlebotomist failed to adequately apply pressure after the procedure to prevent bleeding and a hematoma formed at the site of the blood draw.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by J. Michael Benninger of Benninger Law in Morgantown.

The case has been assigned to Judge Tera Salango.
