Guest names Mountaineer Park, Eldorado Resorts in suit over pool injury

NEW CUMBERLAND – An Ohio woman is suing a Chester resort and casino after she was injured in the pool due to an alleged trip and fall hazard.

Kimberly Kalantzis filed a complaint in Hancock Circuit Court against Mountaineer Park Inc., Eldorado Resorts Inc. and John Does 1-5 alleging negligence.

The suit states that the plaintiff was a guest at the defendants' facility on June 12, 2017. The plaintiff alleges she descended into the outdoor swimming pool via the steps and was caused to fall forward as the steps got deeper at an inconsistent rate, causing injuries to her left ankle. She alleges the fall caused a re-fracture of a previous injury and she needed additional medical treatment.

The plaintiff alleges the deeper step in the pool constituted a trip and fall hazard and the defendants failed to safely operate the pool.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Christopher J. Wallace of The Wallace Firm PLLC in Weirton.

The case has been assigned to Judge Ronald Wilson.
