Mississippi woman files suit against Heartland Express driver over I-68 collision

KINGWOOD – A Mississippi woman is suing a Florida man and his employer over a collision that occurred in Preston County.

Denise Rich filed a complaint in Preston Circuit Court against Heartland Express Inc. of Iowa and Charley Franklin McGarrity Jr. alleging negligence.

The suit states that the plaintiff was driving on April 13, 2017, on Interstate 68 in Bruceton Mills when McGarrity, who was employed by Heartland Express, rear-ended the truck she was driving. She alleges she was injured in the collision.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Wesley W. Metheney of Wilson Frame & Metheney PLLC in Morgantown and James K. Wetzel of Wetzel Law Firm in Gulfport, Mississippi.

The case has been assigned to Judge Steven Shaffer.
