Physician claims West Virginia Board of Medicine unfairly listed him in malpractice report

CHARLESTON—A doctor is suing the West Virginia Board of Medicine, alleging that he was unfairly listed in a medical malpractice lawsuit.

John C. France M.D. filed a complaint in Kanawha Circuit Court against West Virginia Board of Medicine.

The suit states that on July 32, 2017, a patient filed a medical malpractice suit against the West Virginia Board of governors claiming a deviation in the standard of care. Though the plaintiff was not a named party to the lawsuit, the suit states that the plaintiff was named in the settlement report and that this has damaged the plaintiff's reputation.

The defendant is accused of unfair reporting of a medical incident.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Isaac R. Forman of Hissam, Forman, Donovan, Ritchie PLLC in Charleston.

The case has been assigned to Judge Webster.
