Fortner Logging allegedly owes more than $110,000 for John Deere equipment

BECKLEY – John Deere alleges a West Virginia limited liability company failed to pay a balance due on equipment.

John Deere Construction and Forestry Co. filed a complaint in U.S. District Court for the Southern District of West Virginia against Fortner Logging LLC and Martin Easton Fortner alleging failure to pay.

The suit states that the defendants purchased equipment from the plaintiff in February 2017. The suit states the defendants agreed to pay $163,480.68 for the equipment in 36 monthly payments.

The defendants allegedly have failed to pay the plaintiff for the full amount and are still indebted for $113,495.11.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by W. Bradley Sorrells and Marissa R. Grifka of Robinson & McElwee PLLC in Charleston.
