Milton woman files negligence suit after she was allegedly stranded on I-64 without gas for 10 hours

CHARLESTON – A Milton woman has filed suit against a Kanawha County law enforcement office over allegations she was stranded on an interstate without gas for 10 hours and no one stopped to assist her.

Rebecca A. Goodman filed a complaint April 22 in Kanawha Circuit Court against the Kanawha County Police Department, Kanawha Magistrate Office personnel, Danny B. Poik and Lynn Lowe alleging negligence.

The suit states that the plaintiff ran out of gas on April 12 on westbound Interstate 64. The plaintiff alleges she waited for 10 hours until she was aided by a man who stopped. She alleges she saw "at least" five sheriff's office deputies pass her and the West Virginia courtesy patrol and no one stopped to assist her.

The plaintiff is representing herself.

The case has been assigned to Judge Tod Kaufman.
