Insurance company seeks more than $15,000 from St. Albans shop over allegedly faulty brake repair

CHARLESTON – An insurance company alleges a St. Albans tire shop's negligence in a brake repair led to a collision and is seeking subrogation.

West Virginia National Auto Insurance Co., as subrogee of Roger Burress, filed a complaint in Kanawha Circuit Court against A&M Used Tires LLC alleging negligence.

The suit states that on March 31, 2018, a 2005 Chevrolet HHR that was driven and owned by Burress collided with another vehicle as Burress was exiting the garage area at the defendant's business. The suit states the HHR just had its brakes replaced by the defendant and they had failed at the time of the collision.

The plaintiff alleges it paid for the damages that the accident caused, which totaled $15,583.70.

The plaintiff is seeking $15,583, post-judgment interest and court costs. The plaintiff is represented by Ryan S. Marsteller of Bailes, Craig & Yon PLLC in Huntington.

The case has been assigned to Judge Charles King.
