Couple alleges property was damaged by a negligent Wheeling crew during waterline repair

WHEELING – A Wheeling couple is suing the city over allegations that their property was damaged by a negligent crew during the repair of a waterline.

David F. Cross and Cheryl A. Cross filed a complaint in Ohio Circuit Court against the City of Wheeling alleging negligence.

The suit states in July 2018, an employee of the defendant contacted the plaintiffs seeking permission to come onto their property to repair a waterline break. The plaintiffs granted permission, the suit states, and advised the employee of utility and drainage lines that ran through the property. They allege the defendant's employee agreed to maintain a proper lookout.

The suit states defendant came with large machinery and heavy equipment on July 8, 2018, and crushed the plaintiffs' drainage lines and caused damage to their retaining wall, concrete and pool.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiffs are representing themselves.

The case has been assigned to Judge Michael Olejasz.
