West Virginia Cashin Recyclables alleges tenants improperly installed roof

WINFIELD – A Nitro recycling company alleges tenants failed to properly install a metal roof on a building on the property as agreed in the lease.

West Virginia Cashin Recyclables Inc. filed a complaint in Putnam Circuit Court against MCS of West Virginia/FLA, WCC LLC and John Poteat alleging breach of contract.

The suit states that the defendants were leasing a property in Poca from the plaintiff for $3,125 per month for 18 months. In exchange for the lease, the defendants allegedly had agreed to supply labor and to install a new roof. 

The plaintiff alleges the roof was installed incorrectly and that it has suffered damages as a result. The plaintiff alleges the cost to repair the faulty roof is $185,000 and despite its requests that the defendants repair it, they have failed to do so.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. It is represented by Zachary J. Rosencrance and Marc A. Monteleone of Bowles Rice LLP in Charleston.

The case has been assigned to Judge Joseph Reeder.
