Buyers allege Devonshire Townes II failed to make repairs as outlined in agreement

WINFIELD – A Putnam County couple alleges the seller of their property failed to repair all of the items as outlined in their purchase and sale agreement.

Johnnie Sawyer and Veronica Sawyer filed a complaint in Putnam Circuit Court against Devonshire Townes II LLC alleging breach of contract.

The suit states that the plaintiffs purchased a property in Scott Depot from the defendant on Jan. 18, 2013. The plaintiffs allege they were then given an addendum with a list of 29 items to be repaired as additional consideration for the plaintiffs' purchase price. They allege the list was left uncompleted and there are six items that the defendant has not finished. 

The plaintiffs allege they have requested the defendant repair the issues, but it has not done so. They allege they have been damaged in the cost of replacing the floor and for estimates for replacing and/or repairing other items.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. The plaintiffs are represented by Michael J. Del Guidice of Ciccarello, Del Guidice & Lafon in Charleston.
