West Virginia Paving alleges Mike Enyart & Sons failed to pay it for project work

BECKLEY – A Dunbar paving company alleges it was not paid for work on a project by the company that hired it.

West Virginia Paving Inc. filed a complaint in Raleigh Circuit Court against Mike Enyart & Sons Inc. alleging breach of contract and unjust enrichment.

The suit states that the defendant contracted the plaintiff for completion of a project. On Sept. 28, 2017, the plaintiff alleges it sent the defendant an invoice for the total of $686,647.29 to cover the costs of work and materials. The defendant allegedly failed to pay the full amount of the first invoice, and is still indebted for $236,647.29.

The plaintiff alleges it sent another invoice on June 28, 2018, for the amount of $27,148.46 but the defendant failed to pay the invoice. 

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Norman T. Daniels Jr. and Nicholas R. Stuchell of Daniels Law Firm PLLC in Charleston.

The case has been assigned to Judge Darl Poling.
