Pedestrian sues state agency for injuries from fall while walking on McMechen bridge

MOUNDSVILLE – A McMechen woman is suing a state agency after she allegedly sustained injuries while using a pedestrian walkway.

Jane Ann Bartsch filed a complaint in Marshall Circuit Court against the West Virginia Department of Transportation, Division of Highways and National Union Fire Insurance Co. of Pittsburgh alleging negligence.

The suit states that the plaintiff was walking across the Sixth Street Bridge in McMechen on July 8, 2018, when she was caused to fall because a metal connection plate raised when she stepped on it. She alleges she sustained injuries to her face, wrist, knee and other body parts.

The plaintiff alleges she notified the DOH of her claim, but the National Union Fire Insurance Co. of Pittsburgh claims administrator stated there was no coverage for her claim.

The plaintiff seeks a declaration from the court that coverage exists for her injuries.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Michelle Marinacci of Gold, Khourey & Turak LC in Moundsville.

The case has been assigned to Judge David Hummel.
