Kirk Trucking alleges Bluestone Industries failed to pay for hauling of equipment

WILLIAMSON – A Kermit trucking company alleges it was not paid for two jobs it was hired to do by a coal company.

Kirk Trucking Co. filed a complaint in Mingo Circuit Court against Bluestone Industries Inc. alleging breach of contract and failure to pay.

The suit states that the plaintiff was contracted by the defendant on April 21, 2017, to transport two pieces of equipment and that the plaintiff completed said work. The plaintiff alleges it billed $9,000 for one job and $4,200 for the second, but the defendant only paid $4,500 for the first job and has not remitted payment for the second.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Greg K. Smith of the Law Office of Greg K. Smith of Williamson.

The case has been assigned to Judge Miki Thompson.
