HERC Oil and Gas seeks return of more than $60,000 it paid for lease that allegedly did not have good title

WEST UNION – An oil and gas company alleges it paid several thousand dollars for a lease when the assignor did not have a good title.

HERC Oil and Gas LLC filed a complaint in Doddridge Circuit Court against P.G. Oil & Gas LLC and Perry Gains alleging unjust enrichment.

The suit states Gains assigned to plaintiff oil and gas formations in 2014 and the plaintiff paid him $66,500 for the assignment. In September 2018, P.G. Oil & Gas warranted that the lease was currently in production, the suit states.

The plaintiff alleges it has learned Gains did not have a good title to the oil and gas lease and has requested the return of $66,500, but the defendants have refused to pay it.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Kevin White in Saint Marys.
