CHARLESTON – Damages are sought from a state agency over a 2017 fatal crash on Route 10.

The estate of Brittany Lester, by Walter Lester as administrator of the estate, filed a complaint in Kanawha Circuit Court against West Virginia Department Transportation, Division of Highways alleging negligence.

The suit states that Lester was a passenger in a vehicle on April 5, 2017, traveling north on new Route 10 near Lyburn. The suit states a semitruck was traveling south on old Route 10 and the two vehicles collided at the intersection, resulting in Lester's death.

The plaintiff alleges the defendant failed to maintain the intersection with adequate signage and knew or should have known the intersection was unsafe.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Clayton G. Anderson and Marvin W. Masters of the Masters Law Firm in Charleston.

The case has been assigned to Judge Charles King.
