Man injured in collision with tractor-trailer alleges LM General Insurance failed to make reasonable offer for claim

WHEELING – An Ohio County man alleges an insurance company has not made him a reasonable offer for injuries he received in a collision with a tractor-trailer.

Michael Z. Gray II filed a complaint in Ohio Circuit Court against LM General Insurance Co., Steven Douglas, Joseph Fontana and John Doe alleging breach of contract, false advertising and other counts.

The suit states that the plaintiff was struck by a tractor-trailer on May 1, 2017, on Interstate 70 while operating his mother's vehicle and was injured. The suit states the tractor-trailer did not stop after the collision and no registration or company information was obtained.

The plaintiff alleges his mother purchased insurance through the defendants for the vehicle and that he was beneficiary under the policy. He alleges LM General Insurance has not made a reasonable or acceptable offer to him.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Randy D. Gossett of Lantz Law Offices in Moundsville.

The case has been assigned to Circuit Judge Ronald E. Wilson.
