J&T Paving, Excavating & Refrigeration alleges it is owed more than $27,000 for parking lot work

NEW MARTINSVILLE – A New Martinsville company alleges that it was not paid for work it completed on a parking lot in the city.

J&T Paving, Excavating & Refrigeration Inc. filed a complaint in Wetzel Circuit Court against Dr. Don Chapman D.D.S. PLLC and Blattner and Howard LLC alleging breach of contract and unjust enrichment.

The suit states that the plaintiff and Blattner entered into a series of contracts in May 2017 for the excavation, paving and line striping of a parking lot at Chapman's New Martinsville office. The plaintiff alleges it completed the work and submitted the invoices to Blattner for payment. Blattner allegedly has failed to pay the plaintiff $27,687 for the services.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Christina S. Terek and Gerald E. Lofstead III of Spilman, Thomas & Battle PLLC in Wheeling.

The case has been assigned to Judge Jeffrey Cramer.
