Clayton Fitzsimmons recently presented at the West Virginia Association for Justice’s 61st Annual Convention and Seminar which took place June 6th and 7th in Charleston, West Virginia. Clayton’s presentation was entitled State and Federal Mass Torts Litigation and the West Virginia Opioid Crisis. Clayton spoke on the West Virginia state litigation involving claims brought by governmental entities and hospitals throughout West Virginia against various opioid manufacturers and distributors arising from the opioid epidemic that is plaguing West Virginia and surrounding areas. Clayton is co-counsel and represents 13 West Virginia counties and roughly 33 West Virginia hospitals in current opioid lawsuits pending in West Virginia state court. Clayton co-presented with attorneys Tony Majestro and Lee Javins from Charleston, West Virginia.

Clayton is a managing member of Fitzsimmons Law Firm PLLC where he concentrates his practice on complex litigation, workplace accidents, defective products, toxic exposure, and commercial motor vehicles. Clayton is licensed to practice law in West Virginia, Ohio and Pennsylvania and has litigated and obtained significant results for his clients in personal injury and wrongful death claims in multiple states and jurisdictions. Clayton received his undergraduate degree from Cornell University—where he also played football—and his law degree from the University of Notre Dame where he graduated with honors. Clayton is also a published author having co-authored a chapter in a medical textbook on neurological sports injuries and a chapter in a medical-legal handbook.
