Wheeling property owner alleges Mike Enyart & Sons work on sewage lines caused collapse of line

MOUNDSVILLE – A property owner is seeking damages from an Ohio-based underground utility contractor over allegations its work on a sewage line caused damages to the property.

Indian Point Properties LLC filed a complaint in Marshall Circuit Court against Mike Enyart & Sons Inc. alleging negligence.

The suit states that the plaintiff is the owner of a property at 9 Ruth Ave., Wheeling and the defendant entered into contracts with the Marshall County Sewerage District. One of those contracts was the installation of a sewage line in Carl Street in Wheeling, the suit states.

The plaintiff alleges its property is adjacent and downhill to a space where the defendant was working on Carl Street. The plaintiff alleges the defendant's negligent work caused the collapse and/or interruption of one or more sanitary sewer lines, slippage, damages to the house and a discharge of sewage close to the property.

The plaintiff is seeking all reasonable sums due and interest. The plaintiff is represented by Anthony I. Werner and Joseph J. John of John & Werner Law Offices PLLC in Wheeling.

The case has been assigned to Circuit Judge Jeffrey Cramer.
