McDonald's patron alleges fall caused by misplaced dining room chairs caused broken arm

BECKLEY – A Raleigh County woman alleges misplaced chairs at a McDonald's restaurant caused her to fall and break her arm.

Shirley Ann Lewis filed a complaint in Raleigh Circuit Court against TMJ Foods LLC, doing business as McDonald's No. 36043, alleging negligence and premises liability.

The suit states that the plaintiff was a guest at the defendant's Downtown Beckley McDonald's on June 27, 2018, to purchase breakfast. She alleges employees were mopping the floor at the time of her visit and she was maintaining a vigilant lookout, but did not notice a hazard presented by misplaced high-back dining chairs and caught her foot on them. She alleges she fell as a result and broke her arm.

The plaintiff alleges the defendant should have known that mopping the floor during a peak hour presented an unreasonable, high-risk of injury to patrons.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by John J. Mize of Mize Law Firm in Beckley.
