Ye Olde Alpha server alleges hole in storage area caused back injuries

WHEELING – A Wheeling property owner and the owner of a restaurant/bar are facing a lawsuit from a server over allegations a hole in the basement storage area caused her to injure her back.

Jessica L. Helfer filed a complaint in Ohio Circuit Court against Grexican LLC and Ye Olde Alpha Inc. alleging negligence, premises liability and deliberate intent.

The suit states that the plaintiff was employed as a server at Alpha's restaurant/bar on the premises owned by Grexican. The suit states on May 30, 2017, the plaintiff was organizing and stocking a delivery in the basement storage area when her foot came into contact with a hole and drain in the floor, causing her to fall and injure her back.

The plaintiff alleges Grexican owed a duty to provide a safe and suitable premises and Ye Olde Alpha failed to provide a safe working environment.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Robert V. Berthold Jr. and Robert V. Berthold III of Berthold Law Firm in Charleston and R. Dean Hartley, Leslie Ann James and Tejinder Singh of Hartley Law Group PLLC in Wheeling.

The case has been assigned to Circuit Judge Michael J. Olejasz.
