Property owner alleges Bizzack Construction roadwork damaged home

HUNTINGTON – A man in Fraziers Bottom alleges a highway contractor is responsible for damages to his property relating to road construction.

Richard Ferguson filed a complaint in U.S. District Court for the Southern District of West Virginia against Bizzack Construction LLC.

The suit states that the plaintiff completed the construction of his home in 2011. The suit states in 2017 and 2018, the defendant was engaged in a government contract to perform road construction activities that required blasting activity in close proximity to the plaintiff's home. Following the work, the plaintiff alleges he noticed that there was a great deal of damage to his property, including cracks in the basement wall.

The plaintiff is seeking judgment in the amount of $250,000, attorney fees and court costs. The plaintiff is represented by James D. McQueen Jr. of McQueen Davis PLLC in Huntington.

The case has been assigned to Judge Robert Chambers.
