Customer claims Vallery Chevrolet purposely sold him a defective pickup

CHARLESTON — A man is suing a car dealership, alleging he was purposely sold a defective vehicle.

Matthew Jacobs filed a complaint in Kanawha Circuit Court against Vallery Chevrolet Inc., dba Hometown Certified Preowned.

The suit states the plaintiff purchased a 2010 Ford F-350 from the defendant on Oct. 23, 2018 for $19,900. The defendant allegedly had failed, however, to inform the plaintiff that the vehicle had a number of defects and problems and sold the vehicle anyway.

The defendant is accused of unfair and deceptive acts and practices, common law fraud, and breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Steven S. Wolfe of Wolfe, White & Associates in Logan.

The case has been assigned to Judge Tera Salango.
