Former Lo Down Energy employee claims he was terminated for seeking worker's compensation

WILLIAMSON — A man is suing his former employer, alleging he was terminated for seeking out worker's compensation.

Travis Barbour filed a complaint in Mingo Circuit Court against Lo Down Energy Inc.

The suit states that in March 2019, the plaintiff injured his back while on the job and notified his supervisor, requesting a workers' compensation report. The plaintiff was taken off work by his doctor. In April 2019, the plaintiff's doctor executed a return to work order with modified duty restrictions. The plaintiff returned to work at which point he claims he was told by his supervisor that he wasn't needed any more and was terminated.

The defendant is accused of violation of Worker's Compensation Discriminatory Practices.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Steven Wolfe of Wolfe, White & Associates.
