Visitor claims he tripped and fell on unmarked, non-ramped curb at assisted living facility

WINFIELD — A man is suing an assisted living facility, alleging he was caused to trip and fall due to negligent property management.

James W. Morrison filed a complaint in Putnam Circuit Court against Devonshire Al Operations LLC, dba Bellaire at Devonshire; Devonshire Al LLC; Devonshire Al Holdings LLC; Cathcart Group, fka Cathcart Properties Inc.; and Beacon Communities of West Virginia Inc.

The suit states the plaintiff and his son visited a family member who was residing at Bellaire at Devonshire at 5 Bexley Drive in Scott Depot on May 31, 2017, when the incident took place. The plaintiff alleges he was walking on the sidewalk and was caused to trip and fall off of an unmarked, non-ramped curb in the middle of the sidewalk, causing him to trip and resulting in injuries.

The defendant is accused of negligence and reckless conduct.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Nathan Child of Poca.

The case has been assigned to Judge Joseph Reeder.
