Man claims he was injured in a Cricket Wireless store

CHARLESTON — A customer is suing a phone store, alleging he was injured when a chair broke under him.

James K. Caudill filed a complaint in Kanawha Circuit Court against Cricket Wireless LLC.

The suit states the plaintiff was at the defendant's property at 5707 MacCorkle Ave. in Charleston on Nov. 23, 2018 when the incident took place. The plaintiff alleges he sat in a chair that subsequently collapsed due to a defect. The defendant alleges plaintiff should have removed the chair from the room due to the fact that it was structurally unsound.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Harvey Peyton of Peyton Law Firm in Nitro.

The case has been assigned to Judge Tod Kaufman.
