ACF Environmental claims customer has failed to pay more than $120,000

WHEELING — A materials company is suing a client who allegedly owes more than $120,000.

ACF Environmental filed a complaint in Ohio Circuit Court against Keith Nicholson Services LLC and Joseph Keith Nicholson.

The suit states the plaintiff and defendant entered into an agreement on July 18, 2018 in which the plaintiff agreed to issue materials needed for work on a construction project. The defendant was to pay the plaintiff in a matter of 30 days, but has allegedly failed to do so. The plaintiff is now seeking $120,329.52 from the defendant.

The defendant is accused of breach of contract and unjust enrichment.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Kelly Kamble of Spilman, Thomas & Battle in Morgantown.

The case has been assigned to Judge David Sims.
