Phillip Respironics seeks more than $170,000 on open account

CHARLESTON — A company is suing a client, alleging it failed to pay for materials that were issued.

Phillip Respironics Inc., as assignee of VGM Financial Services Inc., filed a complaint in Kanawha Circuit Court against Boll Medical Inc. and Charles Boll.

The suit states the plaintiff and defendant were involved in an agreement beginning on Sept. 26, 2016. The plaintiff sold and delivered the defendant goods, wares and merchandise that the defendant had agreed to pay for. The defendant, however, allegedly has failed to make the necessary payments. The plaintiff is seeking $170,716.96 from the defendant.

The defendant is accused of breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Arch Riley Jr. of Berstein-Burkley PC in Wheeling.

The case has been assigned to Judge Tod Kaufman.
