State accreditation body files lawsuit against West Virginia Business College

CHARLESTON — The West Virginia Council for Community and Technical College Education is suing a college for allegedly failing to remain accreditation or pay a surety bond owed.

The Council filed a complaint in Kanawha Circuit Court against Travelers Casualty and Surety Co.; USI Insurance Services LLC; The West Virginia Business College Inc., et al.

The suit states the defendant was required to be accredited in order to maintain its permit to operate in West Virginia. The defendant, however, lost accreditation on April 20, 2017 and the plaintiff withdrew its permit on June 30, 2017. The plaintiff has instructed the defendant regarding the specific functions required to provide for student needs, but the defendant allegedly has failed to perform those functions, leaving students without any way to validate documentation needed to seek employment, become licensed or pursue further education. Additionally, the defendant has allegedly failed to pay the plaintiff a debt owed of $35,000.

The defendant is accused of failure to pay surety bond and failure to remain accredited.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Candace Kraus in Charleston.

The case has been assigned to Judge Charles King.
