Town of Glasgow is accused of water damage leading to mold growth in residents' home

CHARLESTON — A family is suing the town they live in, alleging their property was damaged by malfunctioning pipes.

Pearl Barton, Dennis Barton and Melody Barton filed a complaint in Kanawha Circuit Court against the Town of Glasgow.

The suit states the plaintiffs own the property at 12 Second Ave. in Glasgow. The defendant's utility operations include collection and transportation pipes in the vicinity of the plaintiffs' home. The plaintiff's home allegedly was caused water damage when the defendant's utility pipes malfunctioned. The defendant reportedly has failed to remedy the situation in a timely manner, leading to mold growth in the plaintiffs' home.

The defendant is accused of trespass, nuisance and abatement.

The plaintiff is seeking all reasonable sums due, attorney's fees and court costs. The plaintiff is represented by G. Patrick Jacobs of Jacobs Law Office in Charleston.

The case has been assigned to Judge Tera Salango.
