Man claims collection agency violated law by publishing his debt to coerce payment

CHARLESTON — A man is suing a debt collection agency, alleging that his debt was unfairly published.

Bryan Fink filed a complaint in Kanawha Circuit Court against MRS BPO LLC.

The suit states the defendant, who is in the debt collection business, published the plaintiff's debt in an effort to coerce payment. The defendant's alleged behavior has resulted in undue and unreasonable annoyance and oppression for the plaintiff and has caused the plaintiff emotional distress.

The defendant is accused of negligence, illegal threat of emergency situation, common law invasion of privacy, tort of outrage and other tort.

The plaintiff is seeking all reasonable sums due, attorney's fees and court costs. The plaintiff is represented by Michael Cary of Cary Law Office in Charleston,

The case has been assigned to Judge Louis Bloom.
