Pack's Family Preowned is accused of selling a defective 2007 Hyundai Santa Fe

CHARLESTON — An individual is suing a preowned vehicle dealership, alleging it sold him a defective vehicle.

Taylor Harris filed a complaint in Kanawha Circuit Court against Pack's Family Preowned LLC.

The suit states the plaintiff purchased a 2007 Hyundai Santa Fe from the defendnat. The plaintiff soon noticed that the vehicle was suffering from a number of issues and defects. The plaintiff allegedly took the car to a mechanic who informed the plaintiff that there was extensive rusting in the vehicle's subframe. The plaintiff attempted to return the car to the defendant, but the defendant has denied the presence of any issues.

The defendant is accused of unlawful sales practices in violation of the West Virginia Consumer Protection Statutes and negligent misrepresentation.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Michael Cary of the Cary Law Office in Charleston.

The case has been assigned to Judge Louis Bloom.
