DBI Networks claims Morgantown is denying it access to public rights-of-way for utility installation

CLARKSBURG — A broadband telecommunications service is suing the City of Morgantown for refusing to install facilities.

DBI Networks LLC, dba Clearfiber, filed a complaint in the Northern District of West Virginia against the City of Morgantown.

The suit states the defendant has refused to allow the plaintiff access to public rights-of-way to install telecommunications facilities on existing utility poles that are owned by third parties. The suit claims this is a violation of federal and state law.

The defendant is accused of prohibition of services and bar to entry violation, discriminatory management of Public Rights Way, and violation of due process.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Adam McCoy of McCoy Injury Law in Fairmont.
