Man claims Roane County Sherrif's officers used excessive force in arresting him, left him lying in the snow for an hour

BECKLEY — A man is suing the Roane County Sheriff's Department, alleging he was arrested with excessive force.

Brad E. Proctor filed a complaint in the Southern District of West Virginia against the Roane County Commission, the Roane County Sheriff's Department, and four sheriff's department employees.

The suit states that on Jan. 18, 2018, the defendants entered the plaintiff's home and arrested him on outstanding warrants. The plaintiff did not resist arrest or attempt to flee, but alleges he was nevertheless assaulted by the defendants who kicked, punched and beat him. The plaintiff alleges he was thrown into the snow, where he was left to lie for an hour.

The defendant is accused of excessive force and bystander liability.

The plaintiff is seeking all reasonable sums due, attorney's fees and court costs. The plaintiff is represented by Mark S. Plants of Plants Law Offices in South Charleston.
