CLARKSBURG – A widow and another individual are seeking damages over a fatal collision that involved an Environmental Reclamation Solutions truck and its employee.
Christina Marie Murphy McKinney, as administratix of the estate of Alan McKinney, deceased, and Michael Tyler Asch filed a complaint in Wetzel Circuit Court against Environmental Reclamation Solutions LLC and Vallie Ray Zettler alleging negligence.
The suit states on Nov. 25, 2018, Christopher McKinney was killed and Asch sustained serious injuries on Route 50 near Flinderation Road. The suit states Environmental Reclamation Solutions employee Zettler was operating a Peterbilt water truck and pulled right in front of the vehicle Asch and the decedent were riding in, causing the collision.
The plaintiffs are seeking compensatory damages, attorney fees and court costs. The plaintiffs are represented by Dino S. Colombo and Travis T. Mohler of Colombo Law in Morgantown.
The defendants removed the case to the U.S. District Court for the Northern District of West Virginia.
