Landlord alleges Bojangles' operator owes nearly $40,000 in rent

CHARLESTON – A landlord of a Charleston property alleges that the operator of a restaurant has failed to pay for several months.

Ridge Line Inc. filed the lawsuit against the Rutherford Group in Kanawha Circuit Court alleging failure to cure.

The suit states the plaintiff owns a property in Charleston that is part of the Southridge Center and the defendant occupies it to operate a Bojangles' Famous Chicken 'n Biscuits restaurant. The suit states the defendant was to pay $6,937.50 on the first of each month for rent.

The plaintiff alleges the defendant failed to pay rent from February through June. Ridge Line claims it is owed $38,712.50 as of June for current rent, as well as $4,025 for common area maintenance and other fees and taxes.

Ridge Line is seeking immediate possession of the premises, as well as judgment in the amount of $71,016.75, attorneys' fees in the amount of $10,000 and pre- and post-judgment interest. It is represented by W. Bradley Sorrells of Robinson & McElwee in Charleston.

The case has been assigned to Circuit Judge Tera L. Salango.
