State alleges J M Kiser Construction does not have workers' compensation insurance in violation of law

CHARLESTON – The West Virginia Offices of the Insurance Commissioner is suing Justin Kiser, doing business as J M Kiser Construction, for allegedly failing to obtain or maintain workers' compensation insurance.

OIC filed the lawsuit against in Kanawha Circuit Court. The suit states that Kiser is subject to various fines and penalties as a result of not keeping the insurance. The suit states Kiser can be subject to an injunction to prohibit it from doing business in the state as long as it remains in default.

OIC is seeking all fines and penalties and for Kiser to obtain valid workers' compensation coverage as required by law. It is represented by Jeffrey C. Black of the Legal Services Division in Charleston.

The case has been assigned to Circuit Judge Louis Bloom.
