TH Exploration among defendants accused of failing to enter good-faith negotiations over pipeline right-of-way

MOUNDSVILLE — Four individuals are suing TH Exploration and others for allegedly failing to negotiate in good faith a right-of-way agreement.

Anita Rae Miller, Gerald L. Miller, Gregg A. Miller and Raymond K. Miller filed a lawsuit in Marshall Circuit Court against TH Exploration, XCL Midstream Operating and Micah Feather, claiming the defendants failed to negotiate in good faith regarding a pipeline right-of-way.

The Millers and the defendants could not reach an agreement regarding the right-of-way during negotiations between 2018 and early 2019, according to the suit. The Millers claim the defendants were negligent and caused them to suffer damages.

The Millers are seeking judgment from the defendants and a declaration from the court ordering the defendants to abide by terms previously negotiated. They are represented by Christian Turak of Gold, Khourey & Turak.
