Real estate company sues The Paint Store for alleged breach of lease terms

WINFIELD — Thor Real Estate is suing The Paint Store for allegedly breaching a lease agreement.

Thor Real Estate; Robert T. and Melissa D Meeks LLC; and Robert T. Meeks, an individual, filed the lawsuit in Putnam Circuit Court against The Paint Store and Theodore Miller, claiming they defaulted on their lease and purchase agreements and caused the plaintiffs damages.

The plaintiffs claim the defendants have failed to pay for a delivery van, shelving, fork trucks and fixtures, even though they took possession of them, and that they have only paid $15,000 of $100,000 they were supposed to pay under the purchase agreement.

The defendants breached their contract and were unjustly enriched at the plaintiffs' expense, according to the suit.

The plaintiffs are seeking compensatory and incidental damages with pre- and post-judgment interest. They are represented by M. Shane Harvey, Vivian Basdekis and Chelsea Creta of Jackson Kelly in Charleston.
