Kanawha County woman claims HealthSmart fired her because of age

CHARLESTON – A Kanawha County woman alleges she was terminated from her job of more than 30 years because of her age.

According to a filing in Kanawha Circuit Court, Robin Kelly filed a complaint against HealthSmart Benefits Solutions Inc. alleging her termination from the company was a violation of the West Virginia Human Rights Act. 

The suit states Kelly, 56, had worked for HealthSmart continuously since 1988 and was terminated in January. She alleges she was terminated due to her age.

Kelly seeks back pay, employment benefits, and reinstatement or front pay. She also seeks compensatory damages for embarrassment, emotional distress and mental anguish, along with punitive damages and attorneys' fees and costs. She is represented by J. Michael Ranson and Cynthia M. Ranson of Ranson Law Offices in Charleston.

The case has been assigned to Circuit Judge Tera L. Salango.
