Estate sale attendee alleges Sort My Space failed to warn of unmarked step that caused fall

CHARLESTON – A Charleston man is suing an estate sale organizer alleging that he was injured when he fell on the property. 

Orville King filed a complaint in Kanawha Circuit Court against Sort My Space and Kathy Flowers, administrator of the estate of Jane Doe, alleging negligence.

The suit states that Sort My Space was holding an estate sale at a Charleston property on Jan. 12 that was under the administration of Flowers. The plaintiff alleges he attended the sale and was injured when he fell down an unmarked step. 

The plaintiff alleges the defendants were negligent by failing to warn of the drop off.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Joshua B. Martin of The Martin Law Firm in Nitro.

The case has been assigned to Judge Tera Salango.
