Marshall County property owner alleges Western Construction is trespassing on land

MOUNDSVILLE – The owner of a Marshall County property alleges that a construction company is using part of his property without his permission.

Randall Schmidt filed a complaint in Marshall Circuit Court against Western Construction Inc. alleging trespass.

The suit states that since June 1, the defendant has encroached upon the plaintiff's property located near Dry Ridge Road, Marshall County. The plaintiff alleges the defendant has moved and stored heavy earth equipment, trucks, storage units and other items on the area.

The plaintiff alleges the defendant has not provided him compensation and does not have his permission to use the area.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Anthony I. Werner and Joseph J. John of John & Werner Law Offices PLLC in Wheeling.

The case has been assigned to Circuit Judge Jeffrey D. Cramer.
