Sunbelt Equipment Marketing alleges it is owed more than $300,000 for equipment used in Mountaineer Express project

MOUNDSVILLE – A Texas equipment rental company alleges it was not paid for the use of equipment needed in a major pipeline project.

Sunbelt Equipment Marketing Inc. filed a complaint in Marshall Circuit Court against Columbia Gas Transmission LLC, TransCanada USA Services Inc. and Welded Construction LP alleging breach of contract and unjust enrichment.

The suit states that the plaintiff provided equipment and machinery to Welded Construction for use on the Mountaineer Express Pipeline Project owned by Columbia and TransCanada. The plaintiff alleges Welded failed to pay it for $322,815.12 in invoices and it recorded a mechanic's lien.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Charles R. Hughes of Bowles Rice in Charleston.

The case has been assigned to Judge Jeffrey Cramer.
