Couple sues U-Haul after part of tow dolly struck vehicle on I-77

CHARLESTON – A West Virginia couple alleges they were injured when part of a U-Haul tow dolly broke away and struck their vehicle while traveling in Kanawha County.

Frankie J. Facello Sr. and Phyllis G. Facello filed a complaint in Kanawha Circuit Court against U-Haul Co. of Arizona, U-Haul Co. of Colorado and U-Haul International Inc. alleging negligence.

The suit states Frankie Facello was driving a 2015 Mitsubishi Outlander on May 17, 2018, on Interstate 77 and Phyllis Facello was a passenger in the vehicle. The plaintiffs allege Harry Stewart was operating a U-Haul box truck and hauling a passenger car on a tow dolly and part of the dolly separated and struck the plaintiffs' vehicle, resulting in injuries and damages to the plaintiffs.

The plaintiffs allege the defendants had a duty to ensure their fleet of tow dollies were maintained and inspected.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. The plaintiffs are represented by Robert D. Cline Jr., Brian E. Bigelow and Benjamin N. Hatfield of Farmer, Cline & Campbell PLLC in Beckley.

The case has been assigned to Judge Joanna Tabit.
