Woman files suit against ex-husband's corporation over allegedly unpaid spousal support

FAYETTEVILLE — A Kanawha County woman has filed a suit against her ex-husband's company over allegations he has failed to comply with a notice of withholding for spousal support.

Elizabeth Graves filed a complaint in Fayette Circuit Court against West Virginia Environmental Services Inc.

The suit states the plaintiff is a party in a divorce action against Michael Graves, who is a sole/majority shareholder in the defendant corporation. She alleges Michael Graves is under a voluntarily assumed obligation to pay her spousal support per a July 2014 order.

The suit states Michael Graves was inconsistent and incomplete with making payments, so the Fayette Family Court issued an order directing income withholding on Jan. 29. The plaintiff alleges Michael Graves has failed and refused to honor the notice of withholding since April and is seeking judgment of $30,498.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Mark A. Toor in Charleston.

The case has been assigned to Circuit Judge Thomas Ewing.
