Fraziers Bottom property owner seeks more than $250,000 from Bizzack Construction over alleged blasting damages

WINFIELD – A Fraziers Bottom property owner alleges nearby blasting activity caused damages to his home.

Richard Ferguson filed a complaint in Putnam Circuit Court against Bizzack Construction LLC alleging trespass.

The suit states that the plaintiff completed the construction of a house at 715 Marion Drive, Fraziers Bottom in 2011. The suit states that the defendant was engaged in road construction work near the plaintiff's home in 2016 and 2017 and the defendant's work resulted in damages to the plaintiff's home.

The plaintiff is seeking no less than $250,000 in damages, attorney fees and court costs. The plaintiff is represented by James D. McQueen Jr. of McQueen Davis PLLC in Huntington.

The case has been assigned to Judge Joseph Reeder.
