Elkview resident files suit against Gateway Mortgage Group over foreclosure

CHARLESTON – An Elkview woman is suing her mortgage servicer over allegations it failed to provide appropriate loss mitigation.

Catherine Renea Woodfell filed a complaint in Kanawha Circuit Court against Gateway Mortgage Group LLC alleging misrepresentation in debt collection, illegal debt collection and other counts.

The suit states that the plaintiff and her disabled husband were struggling financially for a number of reasons and due to their challenges, sought out help from the defendant for their mortgage. The suit states the plaintiff has a Federal Housing Administration loan and as a result, the defendant is contractually obligated to assist her.

The plaintiff alleges the defendant has refused to give her the requested assistance and has subjected her to erroneous property inspections and illegal fees. The defendant is now seeking to foreclose on the property.

The plaintiff is seeking a declaration that the defendant breached the contract, actual and punitive damages, attorney fees and court costs. The plaintiff is represented by Sarah K. Brown, Bren J. Pomponio and Daniel F. Hedges of Mountain State Justice Inc. in Charleston.

The case has been assigned to Judge Louis Bloom.
