CHARLESTON – A man whose new tires started failing almost immediately filed a lawsuit against the company that sold him the tires.
Michael Short filed his complaint in Kanawha Circuit Court against Poor Boyz Auto.
Shortly after driving down the road with his new tires, Short said they began to display signs of defect, such as not fitting properly and bubbling on the side, the lawsuit said. Short said an accident could have occurred due to the negligence of the defendant, according to the lawsuit.
The defendant is accused of unjust enrichment, negligence and breach of implied warranty.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is representing himself.
The case has been assigned to Judge Joanna Tabit.
